These Terms of Service (“Terms”) govern your use of https://hypefindzz.com (the “Site”) and purchases of HypeFindzz products operated by Treva Hancock d/b/a HypeFindzz (“HypeFindzz,” “we,” “us,” or “our”). By using the Site or buying from us, you agree to these Terms.

1. Who we are

HypeFindzz sells sealed mystery bags and related generic, non-branded squishy and sensory toys. Orders ship from Lucerne, California.

2. Eligibility

You must be at least 18 years old (or the age of majority where you live) to purchase. If you buy as a gift for a child, you are the purchaser and remain responsible for age-appropriate use and supervision.

Our products are not for children under 3 (small-parts / choking hazard). That is a product-safety rule, separate from online privacy age rules.

3. Products — mystery bags and add-ons

• Mystery bags contain random generic items. You choose bag size/style (or an add-on SKU); you do not choose the exact toys inside a mystery bag.
• Names describe look or style only. Items are generic and non-branded.
• Photos and descriptions are illustrative of style; actual contents of a mystery bag vary.
• Pre-sale or “limited” labels mean availability can change. If we cannot fulfill an order, we may cancel it and refund you through Whop.

4. Payments and Whop checkout

Checkout is hosted by Whop, not on a card form on this Site. “Buy” / “Pay” opens Whop’s hosted checkout for that product (card, Apple Pay, Google Pay — methods may change).

Under Whop’s public seller terms, Whop generally acts as merchant of record for card-network rules and payment settlement only, and HypeFindzz is the supplier of the products for other purposes (including delivery, customer support, and product-related refunds). Whop typically appears as the payment processor on your card statement; we are identified as the supplier at checkout or on your receipt. See Whop Seller Terms.

• We do not receive your full payment card number.
• Shipping address and order details are collected in Whop checkout and shared with us as needed to pack and ship.
• Prices are shown before you pay. Applicable taxes may be calculated and collected at Whop checkout depending on Whop’s tools and your location.
• Payment disputes and chargebacks may involve Whop and your card issuer. Product issues (wrong item, damage, returns) are handled under Returns below, then processed through Whop’s payment flow once we approve a refund.

When you pay on Whop, Whop’s terms and privacy policy also apply to that checkout experience.

5. Shipping

• Orders ship sealed from Lucerne, CA.
• U.S. delivery is typically about 3–7 business days after packing. That is an estimate, not a guarantee. Carrier delays, weather, and address errors can add time.
• You are responsible for providing a correct shipping address at Whop checkout.
• Risk of loss passes to you when we deliver the package to the carrier, except where applicable law requires otherwise.
• We currently ship within the United States unless a listing expressly says otherwise.

6. Returns and refunds

Unopened bags: Within 14 days of delivery, unused and still sealed — email hypefindzz@gmail.com for return instructions. Unless we tell you otherwise for a particular order, you are responsible for return shipping on unopened returns. We will refund the product price through Whop after we receive and confirm the sealed return; original outbound shipping is generally non-refundable unless we made an error.

Opened mystery bags: Final sale. Once opened, the surprise cannot be returned as unused.

Damaged or defective on arrival: Email photos and your order info within 7 days of delivery. We will replace or refund as appropriate.

Approved refunds are processed through Whop’s payment flow. Timing depends on Whop and your payment method.

7. Age and safety

Not for children under 3. Products may contain or break into small parts and present a choking hazard. Keep sealed bags and pieces away from babies and toddlers. Adult supervision is recommended for young children.

Age guidance on listings describes intended users; it is not a substitute for caregiver judgment.

Online privacy (children under 13) is covered in our Privacy Policy, not by the “under 3” toy label.

8. Generic toys and intellectual property

All HypeFindzz items are generic, non-branded toys. Product names describe look or style only. We are not affiliated with, endorsed by, or official sellers of any trademarked brand, character, mascot, or licensed property. We do not claim logos or licenses we do not have.

The Site’s content (text, layout, original graphics we own) is protected by applicable IP laws. You may not copy the Site for commercial use without our permission.

If you believe a listing creates confusion with a brand, email hypefindzz@gmail.com and we will review.

9. Acceptable use

You agree not to:

• use the Site for unlawful purposes;
• attempt to scrape, overload, or disrupt the Site;
• misrepresent your identity in support or chargeback contexts; or
• infringe others’ rights.

We may refuse or cancel orders we reasonably believe are fraudulent or abusive.

10. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” MYSTERY BAG CONTENTS ARE RANDOM WITHIN THE STATED STYLE. WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, EXCEPT WHERE THE LAW DOES NOT ALLOW THAT DISCLAIMER.

Some places do not allow certain disclaimers; those limits may not apply to you. Nothing here limits non-waivable consumer rights.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HYPEFINDZZ’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR A PURCHASE IS LIMITED TO THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS OR DATA), EVEN IF ADVISED OF THE POSSIBILITY.

Some states do not allow certain limitations; those limitations may not apply to you. Nothing in these Terms limits rights that cannot be waived under applicable law (including certain California consumer rights).

12. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules, except where mandatory consumer law in your place of residence says otherwise.

If a dispute arises, we encourage you to contact us first at hypefindzz@gmail.com. You and we retain any rights to bring claims in a court of competent jurisdiction, including small-claims court where available. These Terms do not require binding arbitration.

13. Changes

We may update these Terms by posting a new version on this page and changing the “Last updated” date.

If you continue to use the Site after the effective date, you accept the updated Terms, except where law requires otherwise. For orders already placed, the Terms in effect at purchase generally control, unless we say otherwise and law allows.
